here's the situation...

the husband was caught having an affair...the guy left home....just to get back to her husband, she got herself a bf. she got pregnant..the baby is now 2 years old  but they haven't started any legal proceedings..the baby wasn't even registered...
what happens now with the baby?
and is it possible that they can file thier annulment in other places like, they're both in baguio, can they file it in buguias?

What happens to the baby? The baby is regarded as an illegitimate child. An illegitimate child is one who was born out of wedlock. The people who have legal and of course parental responsibilty when it comes to the illegitimate child are the boyfriend and the wife.

There is an existing and valid marriage between the spouses so the wife here and the bf can be liable for adultery.

Regarding the venue of annulment cases, according to  the NEW RULE ON DECLARATION OF ABSOLUTE NULLITY OF VOID MARRIAGES AND ANNULMENT OF VOIDABLE MARRIAGES (Supreme Court A.M. N0. 02-11-10) :

Sec. 4. Venue.–The petition shall be filed in the Family Court of the province or city where the petitioner or the respondent has been residing for at least six months prior to the date of filing, or in the case of a non-resident respondent, where he may be found in the Philippines, at the election of the petitioner.

This means basically that they have to live at least six months in the place where they intend to file the annulment of marriage if they are residing in the Philippines. Therefore, in respond to your question, we better look into whether either the husband or the wife lived in that place for at least six months prior to the filing of the annulment of marriage.

If she can afford it, she could have filed adultery/concubinage... when evidence are there... the ex-husband could end up paying a neat sum to her...

but now that the wife had already gotten herself with a boyfriend and gotten herself pregnant... the baby's legality and future is at stake here...

they could file for annulment anywhere provided that both of them are present when they sign the annulment papers...
